Platform Terms

These Terms cover the EatFuti-powered ordering experience you see when you order food from a restaurant whose online ordering, website, or mobile app is built on EatFuti's platform.

These Terms apply to you as a guest, regardless of which restaurant's brand you see on the page. By placing an order through the Platform, you agree to these Terms.

About EatFuti

EatFuti Inc. ("EatFuti," "we," "us") is a restaurant technology company based in Des Moines, Iowa. We build the AI-powered software that powers the ordering page you're using. We don't make the food, set the menu, or set the prices. We don't operate a delivery fleet either. Delivery, where offered, is handled by the restaurant or by third-party delivery networks the restaurant has chosen to integrate with.

Restaurants are independent

The restaurant whose menu you're viewing operates independently from EatFuti. The restaurant is responsible for:

  • Food preparation, quality, and safety
  • Accurate menu, pricing, photos, and allergen disclosure
  • Honoring orders placed on its EatFuti-powered site
  • Customer service for order-specific issues
  • Refunds and exchanges (with EatFuti acting on the restaurant's behalf where applicable)
  • Choosing whether to offer delivery and through which delivery partner

EatFuti doesn't independently verify menu accuracy, food safety practices, or any other representation a restaurant makes through the Platform. If you have a problem with your food, contact the restaurant directly first. We'll help where we can, but we don't control what restaurants do.

If you have a serious food safety concern or believe you've been seriously injured by food from a restaurant, please contact local public health authorities and consider consulting an attorney.

Your account

You may place orders as a guest without creating an account, or you may create an account to save your details for faster checkout. If you create an account:

  • You must be at least 18 years old (or your jurisdiction's age of contract, if higher).
  • You're responsible for what happens under your account. Keep your password private.
  • Tell us right away if you think someone else got in.
  • If you're under 21, you may not order alcohol or any age-restricted product.

Ordering and pricing

4.1 Menu and pricing

The restaurant sets the menu, the prices, and any item-specific limits. EatFuti displays this information as the restaurant provides it. Prices may differ from in-store prices.

4.2 Service fees and taxes

Your total may include:

  • The price of items, as set by the restaurant
  • Applicable sales tax
  • A delivery fee (if delivery), set by the restaurant or the delivery partner
  • A service fee that helps cover platform and processing costs
  • A tip, where applicable, that goes to the person delivering or preparing your order
  • Other fees disclosed at checkout

We try to make every line item clear at checkout before you pay.

4.3 Order accuracy

Review your order before paying. Once placed, orders may be sent to the kitchen immediately. Cancellation isn't always possible.

4.4 Age-restricted products

Some restaurants are licensed to sell alcohol through EatFuti. If you order alcohol:

  • You must be 21 or older
  • A valid government-issued ID will be checked at delivery or pickup
  • Delivery can be refused if you can't show ID, if you appear intoxicated, or if no one of legal age is available to receive it
  • A refused alcohol delivery doesn't entitle you to a full refund of the alcohol portion of the order
  • Where the restaurant uses a third-party delivery partner (like DoorDash) for alcohol, that partner's terms also apply

Payments

Payments are processed by Stripe or another payment processor the Platform uses. EatFuti doesn't see or store your full card number.

By submitting an order, you authorize the processor to charge your payment method for the full amount, plus any tip and applicable fees and taxes.

If a charge is declined, your order won't be placed. If a refund is owed, the restaurant or EatFuti will issue it to your original payment method, usually within five to ten business days, depending on your bank.

Pickup and delivery

6.1 Pickup

If you choose pickup, the restaurant will tell you when your order is ready. Please pick up within a reasonable time. Cold or stale food caused by a late pickup isn't refundable.

6.2 Delivery options

EatFuti does not operate a delivery fleet. Where delivery is available, it is handled by:

  • The restaurant's own delivery staff, or
  • A third-party delivery network the restaurant has integrated with (such as DoorDash, Uber Eats, or a similar service)

The restaurant chooses which option to offer at the time you order. Estimated delivery times are estimates, not guarantees. The restaurant or the third-party delivery network is responsible for the actual delivery.

6.3 At the door

Please make yourself available at the delivery address. The person delivering may try to reach you by call or text. If you're not available within a reasonable time and the order can't be delivered:

  • The order may be left at the door (where the restaurant or delivery partner allows it)
  • The order may be returned to the restaurant
  • A re-delivery may be possible at additional cost
  • A refund may not be available if the failure to deliver is due to your unavailability

6.4 Risk of loss for delivery

Once an order is handed to you (or left at the location you specified), risk of loss is yours. Please bring perishable food inside promptly.

6.5 Third-party delivery terms

When a delivery is fulfilled by a third-party network, that provider's own terms also apply to that leg of the order. EatFuti is not a party to and not responsible for the relationship between you and the third-party delivery provider.

Refunds, cancellations, and missing items

If something is wrong with your order, missing item, wrong item, food quality, late delivery, please reach out to the restaurant first. Most issues can be resolved in a few minutes. EatFuti is happy to help mediate or process refunds where the restaurant authorizes us to.

Refund policies vary by restaurant. EatFuti is not the issuer of food; the restaurant is. We can't compel a refund the restaurant declines, but we may issue partial credits for goodwill in our discretion.

Marketing and messaging

When you place an order, you give the restaurant your contact information so they can fulfill the order and communicate with you about it.

If you opt in (by checking a box or otherwise consenting), the restaurant or EatFuti may send you:

  • Order status updates by email or SMS (always sent, you can't opt out of transactional messages without losing the ability to track orders)
  • Marketing emails and SMS from the restaurant (you can opt out any time via STOP or unsubscribe)
  • Marketing communications from EatFuti about new features or restaurants in your area (separately opt-in)

Standard message and data rates may apply for SMS. Reply HELP for help. Reply STOP to opt out.

Acceptable use

You won't use the Platform to:

  • Place fraudulent orders
  • Use stolen payment methods
  • Harass, threaten, or abuse restaurants, delivery personnel, or other users
  • Place orders intended to defraud or harm the restaurant
  • Reverse-engineer, scrape, or copy the Platform
  • Misrepresent your age to order alcohol or other age-restricted products

We can suspend or close accounts that break these rules. For serious abuse, we may report to authorities.

Disclaimers and liability

The Platform is provided "as is" and "as available." EatFuti makes no warranties of any kind, whether express or implied, about the Platform, the food, or the restaurants.

To the maximum extent allowed by law, EatFuti's total aggregate liability to you for any claim related to the Platform is capped at the greater of $100 or the amount you paid for the order in dispute. We're not liable for indirect, incidental, special, or consequential damages, even if we knew they were possible.

These limits don't apply where prohibited by law. Some states don't allow these limits.

Intellectual property

The Platform, the EatFuti name and logo, and all EatFuti software, designs, and content belong to EatFuti or our licensors. You may use the Platform only as we intended.

Restaurant menus, brands, photos, and content belong to the respective restaurant. Don't copy or reuse them outside of placing an order.

Disputes - arbitration and class action waiver

You and EatFuti agree that any dispute between you and EatFuti about the Platform will be resolved by binding individual arbitration, not in court. Arbitration uses a neutral arbitrator instead of a judge or jury.

YOU AND EATFUTI EACH WAIVE THE RIGHT TO A JURY TRIAL.

YOU AND EATFUTI EACH WAIVE THE RIGHT TO BRING OR PARTICIPATE IN ANY CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING.

Exceptions. Either side can still bring an individual action in small claims court, seek injunctive relief in court for ongoing harm, or sue for intellectual property infringement.

Arbitration is governed by the Federal Arbitration Act and administered by the American Arbitration Association under its Consumer Arbitration Rules. Hearings are held in Polk County, Iowa, unless you choose a documents-only or video hearing for claims under $10,000.

If you start arbitration, EatFuti will reimburse your AAA filing fee unless your claim is for more than $10,000.

This section doesn't apply to your disputes with the restaurant or with the third-party delivery provider. Those are between you and them.

How to opt out of arbitration

You can opt out of Section 12 within 30 days of placing your first order on EatFuti by sending notice to:

Include your full legal name, the email tied to your EatFuti account or your most recent order, and a statement that you're opting out of arbitration.

Governing law

These Terms are governed by the laws of the State of Iowa, USA, without regard to conflict-of-laws principles. If Section 12 doesn't apply for any reason, you and EatFuti submit to the personal and exclusive jurisdiction of the state and federal courts in Polk County, Iowa.

Changes to these Terms

We can update these Terms from time to time. The "Last updated" date at the top will always reflect the latest version. Material changes will be communicated by email if you have an account.

Your continued use of the Platform after a change means you accept it.
